Terms of Service

1. Acceptance of Terms

By creating an account, downloading the TheBusTime app, or using the school admin portal at thebustime.in, you confirm that you:

• Are at least 18 years of age
• Are authorized to act on behalf of the school or organization you represent
• Have read, understood, and agree to be bound by these Terms
• Agree to our Privacy Policy

If you do not agree to these terms, you must not use our services.

2. Description of Services

TheBusTime, developed by CViant Technologies, provides the following services:

• Model 1 – Phone GPS Tracking: Real-time bus location sharing via the driver's smartphone
• Model 2 – Phone + RFID: GPS tracking with RFID card-based student boarding/exit detection
• Model 3 – Standalone RFID + GPS Device: Hardware-based tracking without requiring a driver's phone
• School Admin Portal: Web-based dashboard for managing drivers, routes, parents, students, and alerts
• Parent App: Mobile app for real-time bus tracking and notifications
• Driver App: Mobile app for drivers to share location and manage trips

CViant Technologies reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Accounts & Registration

To use TheBusTime, schools must register through CViant Technologies. By registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account at support@thebustime.in
• Be responsible for all activity that occurs under your account
• Not share your admin credentials with unauthorized persons

Each school is assigned a unique School Code. This code must only be shared with drivers and parents who are legitimately part of your school's bus service.

4. Acceptable Use

You agree not to use TheBusTime for any unlawful or harmful purpose. Prohibited activities include:

• Using the service to stalk, harass, or monitor individuals without their consent
• Attempting to reverse engineer, decompile, or extract source code from the apps or portal
• Uploading malicious code, viruses, or any harmful software
• Creating fake accounts or impersonating another school or person
• Using the service for purposes other than school bus safety management
• Reselling, sublicensing, or commercially exploiting the service without permission
• Interfering with the platform's security, servers, or networks

Violation of acceptable use policies may result in immediate suspension or termination of your account.

5. Subscription & Payment

5.1 Pricing

Subscription pricing is customised based on the number of students, buses, and selected model. Pricing is agreed upon during onboarding. Contact us at support@thebustime.in for a quote.

5.2 Payment

Payments are processed securely through Razorpay. Accepted methods include UPI, credit/debit cards, net banking, and bank transfers. CViant Technologies does not store your payment card details.

5.3 Renewal & Expiry

Subscriptions are valid for the period agreed upon at purchase. Upon expiry, services are suspended. Data is retained for 90 days post-expiry. Schools are encouraged to renew before expiry to avoid service interruption.

5.4 Refund Policy

All subscription fees are non-refundable except where required by law or in the event of a service failure attributable to CViant Technologies. Refund requests must be submitted within 7 days of payment to support@thebustime.in.

5.5 Subscription Pause

Schools may pause their subscription a limited number of times per cycle (e.g., during summer vacations). Pause terms are subject to the plan purchased. Contact support to initiate a pause.

6. Data & Privacy

Your use of TheBusTime involves the collection and processing of personal data. Our handling of this data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

As a school administrator, you are responsible for:

• Obtaining appropriate consent from parents/guardians before enrolling students
• Ensuring drivers are informed that their location is shared during trips
• Complying with applicable data protection laws in your jurisdiction

CViant Technologies acts as a data processor on your behalf for student and parent data. You (the school) are the data controller.

7. Intellectual Property

All intellectual property in the TheBusTime platform — including but not limited to the software, mobile apps, website, logo, UI designs, database structures, and documentation — is owned by or licensed to CViant Technologies.

You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for managing your school's bus service in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of our platform without written permission from CViant Technologies.

8. Disclaimer of Warranties

TheBusTime is provided "as is" and "as available" without warranties of any kind, either express or implied. CViant Technologies does not warrant that:

• The service will be uninterrupted, error-free, or completely secure
• GPS tracking will be 100% accurate at all times
• The service will meet all your specific requirements

GPS accuracy may be affected by environmental factors (tunnels, signal interference), device limitations, or network connectivity. TheBusTime is a tracking aid and should not be used as the sole safety measure.

9. Limitation of Liability

To the fullest extent permitted by applicable Indian law, CViant Technologies shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, revenue, or business opportunities
• Any harm resulting from GPS inaccuracy, app downtime, or delayed notifications
• Any physical harm to students, parents, or any person, arising from the use or inability to use the service

Our total liability to you for any claim arising from use of the service shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless CViant Technologies and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including data protection or privacy rights
• Your use of the service in a manner not authorised by these Terms

11. Termination

CViant Technologies may suspend or terminate your account and access to the service:

• If you violate these Terms or our Acceptable Use Policy
• If your subscription expires and is not renewed
• If we reasonably believe your use poses a risk to the platform or other users

You may request account termination at any time by contacting support@thebustime.in. Upon termination, your data will be deleted per our Privacy Policy.

Sections 7 (IP), 8 (Disclaimer), 9 (Liability), and 10 (Indemnification) survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the use of TheBusTime shall be subject to the exclusive jurisdiction of the courts in India.

We encourage you to contact us first to resolve any dispute amicably before initiating legal proceedings.
